Terms of Service

Please read these Terms of Service ("Terms") carefully before using GOAT MODE (the "App," "Service," "we," "us," or "our"). By creating an account or using GOAT MODE, you agree to be bound by these Terms and by our Privacy Policy.

1. What GOAT MODE Is — and Is Not

GOAT MODE is a mental-performance training app built for competitive swimmers. It provides daily check-ins, mindset "missions," an AI chat coach, breathing and race-preparation tools, and a library of publicly documented mental-training approaches used by real elite swimmers ("Swimmer Journeys").

GOAT MODE is not a medical, psychological, psychiatric, or therapeutic service. It does not diagnose, treat, or provide clinical advice for any mental health condition. Nothing in the App is a substitute for care from a licensed therapist, counselor, physician, or other qualified professional. If you are experiencing a mental health crisis, see Section 8 below.

You are interacting with artificial intelligence, not a human coach or therapist. The "GOAT Coach" chat feature is powered by an AI language model. It is not a licensed sports psychologist, therapist, or coach, and any user who is a minor will see regular reminders that they are talking with AI, not a person.

2. Eligibility and Age Requirements

You must be at least 13 years old to create a GOAT MODE account. We do not knowingly collect personal information from children under 13, and if we learn we have done so, we will delete it promptly.

If you are between 13 and 17 years old, you may only use GOAT MODE with the knowledge and permission of a parent or legal guardian, confirmed at sign-up. Your parent or guardian is responsible for supervising your use of the App and should be told if anything you discuss in the App raises a genuine concern about your wellbeing.

3. Your Account

You agree to provide accurate information when creating your account and to keep your login credentials confidential. You are responsible for all activity that occurs under your account.

4. Subscriptions and Payment

GOAT MODE offers two paid subscription tiers (GOAT MODE PLUS and GOAT MODE PRO), billed monthly or annually. Subscriptions are currently sold only inside our iOS app, as Apple In-App Purchases billed to your Apple Account; Apple handles billing, renewals, cancellation and refund requests. There is no web checkout, and we do not take card payments on our website. Club and team (multi-seat) plans are not available yet. Subscriptions renew automatically unless canceled before the renewal date. Cancel in iOS Settings → your name → Subscriptions; cancellation takes effect at the end of the current billing period. Except where required by law, payments are non-refundable, and refunds for App Store purchases are issued by Apple under Apple's policies. 5. Swimmer Journeys — Real Athlete Content

The "Swimmer Journeys" feature summarizes publicly documented interviews and reporting about how named elite swimmers have described handling pressure, confidence, burnout, and related topics. This content is paraphrased from credible public reporting with a source cited on every entry, is not an endorsement of GOAT MODE by any athlete named, and is provided for educational and motivational purposes only.

6. Acceptable Use

You agree not to use GOAT MODE unlawfully or to harass or harm another person; misuse the AI Coach to generate content unrelated to mental performance coaching; interfere with or disrupt the Service; or misrepresent your age or impersonate another person.

7. AI Coach — Additional Terms

Responses are generated by an AI model and may occasionally be inaccurate or not appropriate to your situation. The AI Coach does not provide medical, psychiatric, nutritional, or legal advice. Conversations are logged so we can operate, secure, and improve the Service, and so messages indicating a possible crisis can be reviewed for safety. AI Coach access requires an active GOAT MODE PLUS or GOAT MODE PRO subscription.

8. Crisis Safety

GOAT MODE is not equipped to respond to mental health emergencies. If a message suggests thoughts of suicide, self-harm, or crisis-level distress, our system interrupts normal coaching and responds with crisis resources (such as 988 in the US, or findahelpline.com internationally) and encouragement to reach out to a trusted adult. If you or someone you know is in immediate danger, call your local emergency number right away. See our Safety page for details of our crisis-detection protocol.

9. Intellectual Property

GOAT MODE's design, software, branding, and original written content are owned by us or our licensors. You retain ownership of what you write in journal entries, check-ins, and chat messages; you grant us a limited license to store and process that content to provide the Service.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE PRIOR 12 MONTHS, OR $50.

12. Indemnification

You agree to indemnify and hold us harmless from claims arising from your violation of these Terms or misuse of the App.

13. Changes to the Service or These Terms

We may update the App or these Terms; material changes will be announced in-App or by email before taking effect.

14. Termination

You may delete your account at any time. We may suspend or terminate access for violations of these Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of GOAT MODE will be resolved in the courts of Dubai, United Arab Emirates, or, at our election, by binding arbitration administered by the Dubai International Arbitration Centre (DIAC) under its rules then in effect, and you consent to that jurisdiction.

If you are a consumer residing in the European Union, the United Kingdom, Switzerland, or any other jurisdiction that grants you mandatory consumer-protection rights that cannot be waived by contract, nothing in this section deprives you of the protection of those mandatory rights, including, where applicable, your right to bring proceedings in the courts of your own country of residence.

17. General Provisions

Entire Agreement. These Terms, together with our Privacy Policy, Subscription Terms, Refunds & Cancellations policy, and Safety & Mental Health Disclaimers, are the entire agreement between you and us regarding GOAT MODE, and replace any earlier agreements or understandings on the same subject.

Severability. If any part of these Terms is found unenforceable by a court or arbitrator, that part will be limited or removed to the minimum extent necessary, and the rest of these Terms will remain in full effect.

No Waiver. If we don't enforce a right or provision in these Terms on one occasion, that doesn't mean we're giving it up — we can still enforce it later.

Assignment. You may not transfer your rights or obligations under these Terms to anyone else. We may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of our assets, or by operation of law.

Force Majeure. We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including outages at our infrastructure providers, natural disasters, war, or government action.

Notices. We may provide notices to you by email, through the App, or by posting on our website. You can reach us at hello@goatmode.app.

No Third-Party Beneficiaries. These Terms are between you and us only. Apple is a third-party beneficiary of these Terms solely with respect to your use of the App on iOS, and may enforce them against you directly.

Class Action Waiver. To the extent permitted by applicable law, any dispute resolution proceeding under Section 15 will be conducted only on an individual basis, not as part of a class, consolidated, or representative action.
